Cancelling Trailer Order

I have paid my deposit for a 19 ft Escape that is due for pickup on November 9, 2020. I want to cancel the order. I realize that Escape will not refund my deposit. Is it possible to give my spot to someone who may want that trailer, with the understanding they pay me the deposit fee. I am not looking to make any money from this transaction.

It's been done before but you may want to run it by ETI. With new ownership they may or may not allow such.

I expect there will be at least a fee for changing the paperwork.

This was in an email confirming our information for the Custom's paperwork.

Please note, if you wish to make any changes to your trailer, (options etc.) please do so before paperwork is processed, i.e., before you confirm your legal name and address. Changes made after you have received your hardcopy will result in a $100CDN reprocessing fee.

If she's already signed off on her build sheet, you would likely have to accept most of the options she selected. The sooner the two of you contact each other and Escape to work something out the better (if possible at all) and the more flexibility you're likely to have in options.

No. I didn’t have those particular options. They never called or responded to my emails. They canceled my order and kept my 2000.00 deposit. Not happy.

I would dispute the charge if paid by credit card. Everyone should pay deposits to ETI with a credit card for this reason. On their website they say only $150 will be forfeited if trailer has not entered production.

And to not respond is frankly arrogant.

I've always been under the impression that a deposit is a firm offer to purchase.

If someone makes a deposit on a trailer you are selling, do you feel free to sell it to somebody else who offers more?
It's unfortunate that circumstances changed, but that's all I can offer.


And Ross, when you were in the cellular business and some firm offered to buy 1,000 cell phones for a price and made a deposit, and then didn't follow through, after you purchased those phones to sell, would you keep the deposit, or cheerfully return it?

It’s not a “raw deal” at all If you did a little reading the terms and conditions you would see the following “ The full deposit becomes non-refundable in the event of order cancellation after your confirmation date”. Seems to me the the original poster had a confirmation date.” Right there for all to read. Why would you expect a reply other than “ sorry you changed your mind”

Here are the terms from ETI:


In the event of an order cancellation, prior to your trailer entering production, Escape will make a full refund of monies paid, less Payment Processor fees incurred in handling the payment and associated refund. At present, fees deducted are 200 CAD or 150 USD, for CAD and USD payments/refunds respectively. The full deposit becomes non-refundable in the event of order cancellation once your trailer entered production."

Three months ahead of time?

#10 is irrelevant to be polite. Never did a 1000 cell phone deal. Did I bend over backwards to give the customer the benefit of the doubt? You have no idea.

As soon as you sign your build sheet confirmation Escape orders the materials and components for your particular trailer and it has entered production.

When you sign your build sheet you sign this.

In order to secure your trailer completion date, we require a deposit of 2,000 USD which is initially refundable, less Payment Processor fees of 150 USD. Upon confirmation of your options, the full deposit amount becomes non-refundable.

The OP needs to call ETI, the key word being call, and get the reason for not being reimbursed, they won't get the answer here.
